The terms and conditions set forth herein are intended to regulate the access, browsing and use of the Lumio CRM platform (hereinafter, "the Platform") by real estate agencies and professionals (hereinafter, "the agencies"), as well as the access and use of any information, tools, functionalities and services offered through it. These terms and conditions may be modified at any time by Lumio CRM, with such modifications taking effect immediately after their publication on the Platform. Continued use of the Platform after any modification implies tacit acceptance of the modified terms.
If the use of certain contents or services offered on the Platform requires specific conditions that differ from those described herein, these shall be set out clearly and accessibly for the user. The use of such contents or services shall imply the express acceptance of the particular conditions applicable to them.
This document regulates the relationship between Lumio CRM and the agencies, establishing the bases upon which access is provided, under a SaaS subscription model, to the customer relationship management tools, agency website functionality, new build property catalogue, portal syndication and other services offered through the Platform. Acceptance of these terms and conditions is an essential requirement for the use of the Platform and its associated services.
To use the services of the Platform, the agencies must register by creating an account and providing an email address and other relevant data. Where a free trial is offered, its duration and any limits on functionality are those stated at the time of sign up. Following registration and payment of the applicable subscription, the agencies will have access to the Platform in accordance with the plan contracted, where they will be able to manage their own records and consult the property and development information supplied by third party providers.
Lumio CRM is not responsible for the accuracy of the data supplied by third party providers, including property developers and catalogue or feed providers, who are solely responsible for any consequences, errors and failures arising from the inaccuracy of the information provided.
Lumio CRM is the owner or, where applicable, holds the necessary licences for the intellectual and industrial property rights required to operate the Platform and to use the contents available through it. This includes, but is not limited to, the Platform itself, texts, photographs, illustrations, logos, trademarks, graphics, designs, interfaces, and any other information or content available, as well as the services provided through it.
The use of trademarks, trade names or other registered distinctive signs, whether owned by Lumio CRM or by third parties, is strictly prohibited without the prior, express and written consent of Lumio CRM or the rights holders. Access to or use of the Platform does not grant any right of ownership, title or possession over the aforementioned elements. Consequently, the agency only has the right to use the contents and services offered by the Platform within their limitations, and exclusively for the enjoyment of the service functionalities.
It is therefore prohibited to modify, copy, reproduce, publicly communicate, transform, distribute or disseminate, by any means and in any form, the entirety or part of the contents and information included in the Platform, as well as any information originating from Lumio CRM, for any purpose, without prior, express and written authorisation. However, the agencies may use the graphic and descriptive material made available to them through the Platform for the promotion and sale of the properties they are marketing, in accordance with the restrictions indicated for each property or catalogue.
Likewise, it is prohibited to remove or manipulate the indications of intellectual or industrial property or other credits that identify the rights holders of the contents present on the Platform, as well as technical protection devices, digital fingerprints, or any protection mechanism or information incorporated into the contents offered on the Platform.
The records, contacts, listings and other business data that an agency creates or uploads to the Platform remain the property of that agency. By sending any information or content to Lumio CRM, you declare, warrant and accept that you have the right to do so freely, that such information does not infringe any intellectual property, industrial, trade secret or any other third party rights, and that the information is not confidential or harmful to third parties. You also undertake to assume responsibility for the communications and contents you send or share through the Platform, exonerating Lumio CRM from any claim, proceedings, damages, costs, fees (including legal fees), interest and expenses, direct or indirect, that may arise.
If you become aware of the existence of any content that is illicit, illegal, contrary to the laws or constituting an infringement of intellectual, industrial or any other type of rights, whether of third parties or your own, you must notify us immediately at hello@lumiocrm.com, so that we can take the appropriate measures at our sole discretion.
Lumio CRM is the legal owner, beneficiary and licensor of the Platform and the software services provided through it. It is strictly prohibited to reproduce, distribute, commercialise, capture, decompile, reverse engineer or use the service in any form without express and written authorisation. Lumio CRM reserves the right to claim compensation for damages and losses that any unauthorised use may cause, without prejudice to the applicable legal actions.
Certain links present on the Platform, such as buttons, direct links, banners or embedded content, may redirect to websites, platforms or pages operated by third parties, unless explicitly stated otherwise. Lumio CRM does not have the capacity, either in human or technical terms, to control, validate or endorse all the information, content, products or services available through such links, and therefore assumes no responsibility whatsoever for the contents or practices of such external pages or platforms.
Likewise, Lumio CRM offers no guarantee and is not responsible for the operation, access, data, quality, accuracy, legality or any other aspect of the third party websites, platforms or pages accessible through the links available on the Platform.
If, after using a link and leaving the Platform, you observe activities or content on third party pages that could be considered illegal, immoral or contrary to good customs, you are requested to notify us immediately. This will allow us to take the appropriate measures to remove such a link, whenever it is within our reach.
The inclusion of links on the Platform to other sites, pages or platforms does not suggest any form of relationship, collaboration or dependence with the owners or managers of such external sites. Lumio CRM imposes specific restrictions regarding the creation of links to the Platform in order to protect its intellectual and industrial property. Consequently, it is prohibited to establish any link to the Platform from sites containing materials, information or content that infringe the law, morality, public order or the rights of third parties.
The applicable regulation for this specific case includes, but is not limited to, the Law on Information Society Services and Electronic Commerce (LSSICE) in Spain, which addresses the responsibility of service providers regarding information provided by third parties and the content to which they redirect through links.
6.1. Plans. The Platform is offered through several subscription plans. The plans available, their functionality limits (such as the number of users, properties and included artificial intelligence credits) and their prices are those published on the pricing page of lumiocrm.com at the time of contracting, which form an integral part of these terms.
6.2. Free trial. Where a free trial is offered, the account will have limited functionality for the period indicated at sign up, after which a paid subscription is required in order to continue using the Platform.
6.3. Payment methods. After selecting a plan, the agencies will make payment through our payment gateway by credit or debit card. Payment processing is carried out by Stripe Payments Europe, Ltd., and card details are entered directly into the payment provider's secure fields and are never stored on our servers. The subscription is renewed automatically, monthly or annually according to the billing cycle selected, until it is cancelled.
6.4. Prices and taxes. Prices are expressed excluding VAT, which is added where applicable according to the billing details provided. Prices may be updated with prior notification, and any change will apply from the following renewal period.
6.5. Catalogue territories and add-ons. Where the plan includes access to a new build catalogue, the subscription grants access to the territories selected at checkout. Additional territories and other optional add-ons are charged at the rates displayed at the time of contracting and are billed together with the subscription.
6.6. Artificial intelligence credits. Each plan includes a monthly allowance of credits for the artificial intelligence functionalities of the Platform. This allowance is reset at each renewal and does not accumulate. Credits acquired separately as an additional pack are added to the balance, carry over between periods and do not expire while the account remains active.
6.7. Promotional codes. Discounts and promotional codes are applied under the conditions published at the time of the offer, are not exchangeable for cash and may be limited in duration, in the number of uses or to specific plans.

It is the responsibility of the agencies to ensure that all data provided is accurate and kept up to date, and to safeguard the confidentiality of their access credentials. The agency is responsible for the activity carried out by the users it creates within its account.
The agencies may cancel their subscription at any time from the billing section of their account. Following cancellation no further charges will be made, and access to the contracted functionalities will continue until the end of the period already paid for. The account will remain accessible for the consultation of invoices and previously generated documents under the conditions in force at that time.
Where the Platform allows sending email or messages on behalf of the agency, the agency must connect its own accounts or channels, and is responsible for the communications sent through them.
Access to and use of the Platform must be carried out in accordance with applicable legislation, the principles of good faith, good commercial practices, and fully respecting the intellectual and industrial property rights of Lumio CRM and of third parties. The use of the Platform for illegal, unauthorised purposes, or purposes contrary to the conditions of use established herein, is strictly prohibited.
The agencies shall assume full responsibility for the consequences that may arise from non compliance with these conditions, including but not limited to:
Non compliance with these rules may lead Lumio CRM to take corrective measures, including the removal or blocking of the offending agency's account and the possibility of exercising the appropriate legal actions for the repair of damages caused.
In relation to the property and development information made available through the Platform, Lumio CRM acts exclusively as an intermediary between the providers of that information, such as property developers and catalogue or feed providers, and the agencies that consult it. Lumio CRM provides a digital environment in which that information is aggregated and presented so that the agencies may use it in their commercial activity.
Lumio CRM does not participate in the transactions between agencies, providers and end clients, nor does it guarantee the truthfulness, accuracy, completeness or timeliness of the information supplied by third parties. All information relating to properties, including but not limited to prices, availability, images, floor plans and quality specifications, is provided by its respective sources, which are solely responsible for its content.
Consequently, Lumio CRM is not responsible for any damage or loss that may arise from the use of information published by third parties on the Platform, nor for the decisions made by agencies or end clients based on such information. Any claim or dispute arising in relation to that information must be directed and resolved directly between the parties involved.
Similarly, where the Platform enables the publication of listings on third party property portals or on the agency's website, Lumio CRM provides the technical means of transmission, and the agency remains responsible for the content published and for compliance with the rules of each destination portal.
This intermediation framework is established without prejudice to compliance with applicable regulations in the field of personal data protection and electronic commerce.
The agencies undertake to ensure that all information they publish or transmit through the Platform is truthful, accurate and up to date. This includes, but is not limited to, data on prices, availability, images, floor plans, quality specifications and any other detail related to the properties they market. The agencies are solely responsible for the verification and proper use of the information available on the Platform before transmitting it to their clients or publishing it externally.
The agencies are likewise responsible for the accuracy of the information they provide during registration and use of the Platform, and must correct or update any incorrect data in a timely manner.
Lumio CRM is not responsible for the inaccuracy or falsity of information provided by third parties. Any damage or loss arising from the use of incorrect or misleading information shall be the responsibility of the party that provided it. The agencies shall indemnify and hold Lumio CRM harmless from any claim, damage or loss that may arise as a result of the inaccuracy of the data they publish or transmit.
11.1. Catalogue information. Where a catalogue of developments is included, the information published in it is made available to the agencies subscribed to the corresponding territories. Certain developments or data fields may be subject to restrictions imposed by their provider, in which case they will only be visible or usable under the conditions indicated for each one. The agencies undertake to respect those restrictions when producing their own commercial materials.
11.2. Images and graphic material. Images of surroundings, locations and properties are provided for illustrative purposes. Lumio CRM holds the rights of use derived from third party licences and does not transfer ownership of such images to the agencies or their end clients.
11.3. Documents and electronic signature. Where the Platform offers the generation, sending and electronic signature of documents, these functionalities are provided as a technical instrument. The content, validity and legal effects of the documents produced are the responsibility of the parties that sign them.
11.4. Updates. Lumio CRM makes reasonable efforts to keep the information received from third party providers updated within the periods agreed with each of them, and reserves the right to modify those periods as its processes are optimised.
11.5. Support and assistance. Lumio CRM provides technical support and assistance in relation to the account and the subscription through the address hello@lumiocrm.com.
Lumio CRM strives to ensure the accuracy, reliability and updating of the information and services offered. However, since it acts as a facilitator of the interactions described above, it cannot guarantee the infallibility of the information provided or the uninterrupted continuity of its services.

Notwithstanding the above, Lumio CRM declares that it has implemented the technical and organisational measures at its disposal, in accordance with the current state of technology, to ensure the proper functioning of the Platform and to minimise, as far as possible, both technical and content errors.
This liability framework is established without prejudice to situations arising from fraudulent acts and to compliance with applicable regulations in the field of personal data protection and electronic commerce, including the LOPDGDD and the LSSICE.
Lumio CRM reserves the right, at its sole discretion, to suspend, modify, restrict or interrupt, either temporarily or permanently, access to and use of the Platform and the services offered through it, for those users who breach any of the terms and conditions established in this document, or where payment of the subscription is not made. This measure applies without prejudice to the right to take the appropriate legal actions and without the affected users being able to claim any compensation.
If any violation of applicable legislation is detected, Lumio CRM may inform the competent police and judicial authorities so that they may proceed in accordance with the law.
In accordance with Regulation (EU) 2016/679 (GDPR), as well as any other applicable legislation in the field of data protection and privacy, all personal data provided during the use of the Platform will be treated with the utmost care and security.
The collection, use, storage and any other form of processing of personal data will be carried out in accordance with our Privacy Policy, which all users must read before using the services offered. That policy details the rights of data subjects regarding their personal data, including access, rectification, erasure, limitation of processing, objection, and portability.
In relation to the data of the clients and contacts that an agency manages through the Platform, the agency acts as data controller and Lumio CRM acts as data processor, processing that data solely in order to provide the contracted services and in accordance with the instructions of the agency.
Lumio CRM undertakes not to reveal personal information to third parties without explicit consent, unless required by law or necessary for the provision of the contracted service.
The headings and titles presented in these Terms and Conditions are for informational purposes only and will not influence, qualify or expand their interpretation.
If any clause of these Terms and Conditions is declared null, invalid or unenforceable, in whole or in part, by a Court, Tribunal or competent administrative body, such declaration shall not affect the validity and applicability of the remaining provisions contained herein.
The failure by Lumio CRM to exercise or enforce any right or provision included in these Terms and Conditions shall not be considered a waiver of such rights or provisions, unless expressly recognised and agreed in writing.
The use of the Platform implies the full acceptance of these Terms and Conditions. If you do not agree with them, you are requested to refrain from using the Platform.
All matters relating to the Platform, including, without limitation, those related to its use and to the validity, interpretation and compliance of these Terms and Conditions, shall be subject to Spanish law, in particular Regulation (EU) 2016/679 (GDPR) and Law 34/2002, dated July 11, on Information Society Services and Electronic Commerce (LSSICE), without prejudice to the specific regulations applicable to real estate activities and to the protection of consumers and users.
For the resolution of any dispute, conflict or claim arising from the interpretation or execution of these Terms and Conditions, the parties expressly waive any other jurisdiction that may correspond to them, submitting to the jurisdiction of the Courts and Tribunals of the city in which Lumio CRM S.L. has its registered office, unless the applicable legislation on consumer and user protection establishes the competence of other judicial bodies.
